Accepting the Audit and Comprehensive Annual Financial Report (CAFR) for the Fiscal Year ending June 30, 2020: ITEM APPROVED 

Draper City has completed the audit for the fiscal year July 1, 2019 through June 30, 2020. State law requires that the report be audited in accordance with generally accepted auditing standards by a firm of licensed certified public accountants.  As required by State law, Draper City’s financial statements have been audited by HBME LLC, a firm of certified public accountants.  The published report will be available from the city web site.

Temporary Land Use Regulation Permitting Tents and Canopies for Temporary Restaurant Dining Space: ITEM APPROVED 

The City has been looking into ways that Draper City can support efforts to follow social distancing guidelines and public health orders related to the COVID-19 global pandemic in relation to restaurants. The result is a six-month temporary land use regulation. Enacting the proposed temporary land use ordinance would allow restaurants in Draper City the opportunity to erect temporary outdoor seating under tents or canopies. Such seating would serve the citizens of Draper while following recommended social distancing guidelines in compliance with State and local public health orders.

PUBLIC HEARINGS 

Amending the Current Fiscal Year 2021 Budget: ITEM APPROVED 

Draper City is amending the current Fiscal Year 2021 Budget which was adopted in June 2020. Throughout the fiscal year, management finds that it is necessary to modify the current budget through a budget reopening. There are seven items being presented to the council for their approval. These items are for new or expanded operational programs and will be funded by an increase in the sales tax that is received by the city. 

Rasmussen Family Commercial Zoning Map Amendment: ITEM DENIED 

On the request of One West Construction, representing Rasmussen Family Limited Partnership, for approval of a zoning map amendment for approximately 9.81 acres located at approximately 12197 S. 300 East. The site has a land use designation of Neighborhood Commercial and is currently zoned A5. The applicant is requesting to rezone the entire property from A5 to CN.  The subject property has historically been utilized as agricultural or farming land since at least 1978 when the City incorporated. The Planning Commission forwarded a negative recommendation to the City Council at their November 12, 2020 meeting on a 5-0 vote.

Rockwell Point Text Amendment: ITEM APPROVED 

On the request of Todd Amberry representing Rockwell Point, LLC for approval of a zoning text amendment that would apply citywide to all properties with the Major Freeway Arterial Frontage Road (MARF) zoning designation. This request is to modify the permitted uses in the zoning district. The MARF zoning district was adopted by the City Council in August, 2019. The applicant is proposing to change four uses from ‘not permitted’ to ‘permitted’. Those four uses are: car wash, convenience store, gasoline service station, and restaurant. No other changes are proposed to the zoning district. All development standards will remain unchanged. The Planning Commission forwarded a positive recommendation to the City Council at their November 12, 2020 meeting on a 5-0 vote.

Shadow Mountain Subdivision Zoning Map and Land Use Map Amendment: ITEM APPROVED 

On the request of David Johnson and Sean Shah for approval of a Zoning Map and Land Use Map Amendment for approximately 0.92 acres located on the north side of 13800 South at approximately 671 E 13800 S. The property is currently zoned RA1. The applicant is requesting that a Zoning Map Amendment and a Land Use Map Amendment be approved to go from RA1 to R3 (Single-family Residential, 13,000 square foot lot minimum) and RA2 (Residential Agricultural, 20,000 square foot lot minimum) zoning; dividing the lot’s zoning. The applicant also wants to divide the Land Use designation across the property, keeping approximately 0.5 acres in the current Residential Low/Medium Density designation and adding 0.42 acres into the Residential Medium Density designation. If approved, the applicant could apply to subdivide the property into two lots, one for the existing house on the property, and one for a new home. The Planning Commission forwarded a positive recommendation to the City Council at their October 22, 2020 meeting on a 5-0 vote.

City Initiated Notice of Continued Item Text Amendment: ITEM APPROVED 

On the request of Draper City for approval of a Text Amendment to Draper City Municipal Code Sections 9-5-045 and 17-1-085. The applicant is requesting that a Text Amendment be approved clarifying that a new notice is not required to be provided for items that are continued to future meetings after the public hearing has been closed. The Planning Commission forwarded a positive recommendation to the City Council at their November 12, 2020 meeting on a 5-0 vote.
